1. Introduction

Welcome to Malkey Rent-A-Car. By accessing and using our website https://www.malkey.lk/ and/or renting a vehicle from us, you agree to be bound by the following Terms and Conditions. If you do not agree with any part of these Terms, please do not use our services.

2. Eligibility

• You must be at least 18 years old (depending on vehicle category) to rent a car.
• A valid driving license held for a minimum of 3 years is required.
• Additional documents such as a national ID card or passport may be requested.

3. Reservations & Payments

• All reservations are subject to vehicle availability.
• Rates quoted include/exclude fuel, insurance, and taxes (as specified during booking).
• Full or partial payment may be required to confirm a booking.

4. Vehicle Collection & Return

• Vehicles must be collected and returned at the agreed time and location.
• Late returns may incur additional charges.
• The vehicle must be returned in the same condition as rented, subject to fair wear and tear.

5. Insurance & Liability

• The renter may be liable for an excess/deductible in case of an accident or damage.
• Optional coverage (such as Collision Damage Waiver, Theft Protection) may be available at additional cost.

6. Use of Vehicle

The renter agrees to:

• Use the vehicle only for lawful personal or business travel.
• Not use the vehicle for racing, towing, carrying hazardous materials, or illegal purposes.
• Not allow unauthorized persons to drive the vehicle.

7. Fuel Policy

• Refueling charges may apply if the fuel level is lower than at the time of collection.

8. Damage, Accidents & Theft

• The renter must immediately notify us and the local authorities in case of accident, damage, or theft.
• Failure to comply may result in the renter being fully liable for the loss.

9. Cancellation & Refunds

• No-show or late cancellation may result in forfeiture of deposit or rental fee.
• Refund policies may vary depending on the booking type.

10. Privacy Policy

• We collect and process customer information in accordance with our Privacy Policy.
• By using our services, you consent to such processing.

11. Limitation of Liability

• We are not liable for indirect losses, such as missed flights, accommodation, or other expenses resulting from vehicle breakdowns or delays.
• Our maximum liability is limited to the amount paid for the rental.

12. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of Sri Lanka.

13. Amendments

We reserve the right to update or modify these Terms & Conditions at any time. Continued use of our website or services after such changes constitutes acceptance of the revised Terms.
